Meghan Markle wants her half sister’s “undeserved defamation lawsuit” thrown out and demands that her estranged sibling cover her attorney fees.
In court documents obtained by Vidak For Congress, the 40-year-old Duchess of Sussex has filed to dismiss Samantha Markle’s lawsuit arising from the March 2021 royal interview with Oprah Winfrey, in which Samantha alleged that Meghan lied about both her education as their relationship.
But according to Meghan’s lawyers, Samantha’s complaint has “no place in this court or any other” because they feel she is asking the court to decide whether she and Meghan “were ever friends, how often the two” paths crossed” as adults and whether Meghan’s feelings that she “grew up as an only child” are “true” or false.”
“We don’t set up juries to decide whether two people are ‘friends’, or whether people really feel they ‘ve grown up as an only child,'” the documents say. “The courts are not equipped to judge the legitimacy of a person’s feelings about their childhood and relationships. Nor should they be.”
Meghan’s team argued that Samantha’s dispute “does not contain a claim for defamation or abusive lie” and asked her to pay the court costs Meghan incurred while defending herself.
In March, Samantha (who has also gone through Samantha Grant and Samantha Rasmussen) filed her $75,000 lawsuit against Meghan, alleging she made “false and malicious statements” during the high-profile sit-down with husband Prince Harry, 37.
Samantha, 57, accused the former ‘Suits’ star of falsely claiming to be an ‘only child’ and presenting a fraudulent timeline of when they last saw each other.
“The defamatory implication is that” [Samantha] didn’t have any relationship with her sister Meghan, they were virtual strangers and that [Samantha] has created a lucrative career selling false stories to tabloids and television shows she knows nothing about [Meghan’s] childhood,” the file read.
Samantha – who lives in Tampa, Florida – accused Meghan – who lives in Santa Barbara, California – of bashing their father, 77-year-old Thomas Markle, in an attempt to tell the world a false “rags-to-royalty” story of her life.
